This Acceptable Use Policy (“AUP”) governs how customers and authorised users may use the Rezvion platform. It is incorporated into the Terms of Service. We may update it from time to time; material changes will be notified at least 30 days in advance.
1. Lawful use
You must use the Service only for lawful purposes and in accordance with all applicable laws and regulations, including:
- Consumer‑protection law (e.g. Books 6 and 7 Dutch Civil Code; Directive 2011/83/EU);
- Food‑information law (Regulation (EU) 1169/2011), including accurate allergen and ingredient labelling;
- Alcohol‑licensing rules (e.g. Dutch Alcoholwet) including age verification on online sales of alcoholic beverages;
- Tax and accounting law, including correct VAT (BTW) treatment and record-keeping;
- Anti‑money‑laundering and sanctions law;
- Data‑protection law (GDPR / UAVG) and the ePrivacy provisions of the Dutch Telecommunicatiewet;
- Consumer‑facing accessibility obligations under the European Accessibility Act (Directive (EU) 2019/882) where applicable.
2. Prohibited content
You must not upload, store, transmit, or distribute through the Service any content that:
- Infringes the intellectual property, privacy, publicity, or other rights of a third party;
- Is unlawful, defamatory, harassing, threatening, hateful, or discriminatory;
- Contains malware, viruses, worms, trojans, or other harmful code;
- Is sexually explicit, depicts minors in any sexualised context, or otherwise would harm minors;
- Misrepresents the source or origin of content;
- Is intended to facilitate fraud, including chargeback fraud or fictitious orders.
3. Prohibited activities
You must not:
- Reverse engineer, decompile, or disassemble the Service, except to the extent expressly permitted by mandatory law;
- Access or attempt to access the data of other Rezvion customers or any system or network without authorisation;
- Probe, scan, or test the vulnerability of the Service, except through our responsible‑disclosure programme at hello@rezvion.nl;
- Bypass or circumvent any technical measure designed to protect the Service or restrict access;
- Resell, sublicense, white‑label, or otherwise commercialise the Service to third parties without our prior written consent;
- Use the Service to send unsolicited commercial communications in breach of art. 11.7 of the Dutch Telecommunicatiewet or analogous EU rules;
- Interfere with or disrupt the integrity or performance of the Service, including by generating excessive load not consistent with normal restaurant use;
- Use the Service to train a competing AI model on data extracted from the Service.
4. Special‑category personal data and minors
You must not use the Service to process special‑category personal data (Art. 9 GDPR) unless inherent to legitimate restaurant operations (e.g. dietary or allergen information voluntarily provided by a guest) and processed under an appropriate Article 9 legal basis. You must not use the Service to process personal data of children under the age of digital consent in your jurisdiction (16 in the Netherlands by default) without verifiable parental consent.
5. Marketing communications
When using the Service to send marketing communications to your guests:
- Obtain a valid lawful basis (typically consent for new contacts; the “soft opt-in” under art. 11.7(3) Telecommunicatiewet for existing customers about your similar products or services);
- Identify yourself clearly as the sender;
- Include a working unsubscribe link and process unsubscribes within five business days;
- Do not buy, sell, or rent guest contact lists.
6. Payments and chargebacks
Payments are processed by Adyen N.V. You must comply with all card scheme rules and Adyen’s acceptable‑use rules. Excessive chargebacks or fraud signals may, at Adyen’s sole determination, result in merchant termination.
7. Reporting and enforcement
Suspected violations may be reported to hello@rezvion.nl. We investigate reports and may, in our discretion, warn the customer, remove offending content, suspend access, terminate the subscription, or refer the matter to law enforcement.
